Land Division & Subdivison Adelaide
A Land Division can be as simple as a shift of the boundary between neighbours to the creation of hundreds of new allotments.
There are two main types.
- 'Torrens Title'
With 'Torrens Title' the property owner owns everything above and below the ground to all extremes of the boundary. All services (electricity, storm water, sewer, telephone) are contained within these boundaries. It also requires a legal direct access to a public road. It is by far the most common form of ownership. - Community Title
Although similar to Torrens Title, differences include:- a common (shared) area is required, with rules to manage it.
- can be a more flexible way to divide land particular with different land uses involved or where existing services cross new boundaries.
- development costs can be less is certain circumstances.
Strata Titles still exist and on occasions need amending but no new Strata Titles may be developed. There is the ability to do something similar under the Community Title legislation. Michael Grear Surveys can assist with amendments to Strata Plans or the creation of a Community Title that acts similarly but more flexibly than a Strata Title.
